Acceptable Use Policy

1. Purpose and Scope

This Acceptable Use Policy ("AUP") governs your use of all mobile applications, websites, and related services (collectively, the "Services") provided by Krickets LLC ("Company," "we," "our," or "us"). This policy applies to all users of our Services, including registered account holders, guests, and any person who accesses or interacts with our Services in any way.

This AUP is incorporated by reference into our Terms of Service and End User License Agreement (EULA). By accessing or using our Services, you agree to comply with this policy. Violation of this policy may result in suspension or termination of your account, removal of content, and/or legal action.

We have established this policy to ensure that our Services remain safe, secure, and enjoyable for all users. We expect all users to act responsibly, respect the rights of others, and comply with all applicable laws and regulations.

2. Acceptable Use

You are encouraged to use our Services for their intended purposes, including but not limited to:

  • Using app features and functionality as designed and documented
  • Creating, sharing, and consuming content in accordance with our guidelines
  • Communicating with other users in a respectful and constructive manner
  • Providing honest reviews, feedback, and ratings
  • Personalizing your experience through settings and preferences
  • Purchasing subscriptions, in-app purchases, and premium features through authorized channels
  • Reporting bugs, issues, and policy violations to help improve our Services
  • Engaging with community features, forums, and social elements in good faith
  • Using accessibility features and accommodations as needed
  • Backing up and exporting your own data where such features are available

3. Prohibited Activities

The following activities are strictly prohibited when using our Services. This list is not exhaustive, and we reserve the right to determine, in our sole discretion, whether any conduct violates the spirit of this policy.

3.1 Illegal Activities

  • Using our Services for any purpose that violates local, state, national, or international laws or regulations
  • Facilitating, promoting, or engaging in illegal transactions, including the sale of controlled substances, stolen goods, or contraband
  • Money laundering, terrorist financing, or other financial crimes
  • Distributing, sharing, or possessing child sexual abuse material (CSAM) or any content depicting the exploitation of minors
  • Engaging in human trafficking, forced labor, or exploitation of any kind
  • Facilitating illegal gambling or unlicensed financial services

3.2 Harmful Content

  • Posting, sharing, or distributing content that promotes, glorifies, or incites violence against any individual or group
  • Harassing, bullying, intimidating, or threatening other users, whether publicly or through private communications
  • Posting hate speech, content that demeans or discriminates against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or veteran status
  • Promoting, encouraging, or providing instructions for self-harm, suicide, or eating disorders
  • Posting content that supports, glorifies, or recruits for terrorist organizations or violent extremist groups
  • Sharing graphic, gratuitous, or excessively violent content without appropriate context or warnings
  • Posting sexually explicit content in apps or contexts where it is not permitted

3.3 Fraud and Deception

  • Impersonating any person, entity, or organization, or falsely claiming an affiliation with any person, entity, or organization
  • Operating scams, phishing schemes, or social engineering attacks to obtain personal information, credentials, or money from other users
  • Spreading misinformation, disinformation, or deliberately misleading content that could cause harm
  • Creating fake or misleading profiles, credentials, endorsements, or qualifications
  • Manipulating or falsifying data, metrics, or analytics

3.4 Intellectual Property Violations

  • Uploading, posting, or distributing content that infringes upon the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party
  • Reproducing, distributing, or creating derivative works of our apps, content, or proprietary materials without authorization
  • Removing, altering, or obscuring any copyright notices, watermarks, or proprietary legends
  • Using our trademarks, logos, or branding without written permission

3.5 Privacy Violations

  • Doxxing: publishing or distributing another person's private or personally identifiable information (such as real name, home address, phone number, email, workplace, or financial information) without their explicit consent
  • Recording, screenshotting, or capturing private conversations, video calls, or other private interactions without the consent of all participants
  • Stalking, surveilling, or persistently monitoring another person's online activity or physical location
  • Collecting, harvesting, or scraping personal data from other users without authorization
  • Sharing or exposing intimate or private images or videos of another person without their consent (including "revenge porn")

3.6 Security Violations

  • Attempting to gain unauthorized access to our Services, servers, databases, networks, or other infrastructure (hacking)
  • Distributing, uploading, or transmitting malware, viruses, trojans, worms, ransomware, spyware, or any other malicious code
  • Probing, scanning, or testing the vulnerability of our systems or networks without express written authorization
  • Attempting to bypass, circumvent, or disable any security features, authentication mechanisms, access controls, or content protection measures
  • Intercepting, monitoring, or eavesdropping on data transmissions not intended for you
  • Launching denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against our Services
  • Exploiting bugs, glitches, or vulnerabilities for personal advantage rather than responsibly reporting them

3.7 Spam and Abuse

  • Sending unsolicited bulk messages, advertisements, or promotional content to other users
  • Using automated tools, bots, scripts, or crawlers to interact with our Services in an unauthorized manner
  • Manipulating reviews, ratings, or rankings through fake reviews, incentivized reviews, or coordinated campaigns
  • Repeatedly posting the same content, messages, or comments (flooding or spamming)
  • Creating multiple accounts to circumvent rate limits, bans, or other restrictions
  • Abusing referral programs, promotional offers, or reward systems

3.8 Commercial Misuse

  • Using our Services to advertise, promote, or sell products or services without our prior written consent
  • Operating competing services, data collection operations, or commercial ventures through our platform
  • Reselling, sublicensing, or redistributing access to our Services or premium features
  • Using our Services to harvest leads, contacts, or data for commercial purposes

3.9 Platform Manipulation

  • Creating fake, bot, or sock puppet accounts to artificially inflate engagement, followers, likes, or other metrics
  • Coordinating inauthentic behavior, such as organized brigading, mass reporting, or coordinated harassment campaigns
  • Using engagement manipulation tactics such as follow/unfollow schemes, like-for-like exchanges, or engagement pods
  • Artificially boosting content visibility through deceptive means
  • Circumventing algorithmic content moderation or content distribution systems

4. Content Standards

All content created, uploaded, shared, or distributed through our Services must comply with the following standards:

4.1 Permitted Content

  • Original content that you have created or have the right to share
  • Content that is lawful, accurate, and presented in good faith
  • Content that respects the rights, dignity, and privacy of others
  • Content that is appropriate for the intended audience of the specific app or feature
  • Licensed or public domain content used in accordance with applicable terms

4.2 Prohibited Content

  • Content that violates any of the prohibited activities listed in Section 3
  • Content that is defamatory, libelous, or constitutes a credible threat
  • Content that promotes dangerous activities, challenges, or stunts that could result in injury or death
  • Deepfakes, AI-generated content, or synthetically altered media designed to deceive, defraud, or harm
  • Content that exploits or endangers minors in any way
  • Content that promotes illegal drug use, underage drinking, or substance abuse
  • Content that violates the content guidelines of the Apple App Store or Google Play Store

5. User-Generated Content Guidelines

If our apps include features that allow you to create, upload, or share content (including but not limited to text, images, videos, audio, and files), you are solely responsible for the content you contribute. By submitting user-generated content, you agree to:

  • Ensure that your content complies with this AUP and all applicable laws
  • Only share content that you own or have the right to distribute
  • Accept that your content may be reviewed, moderated, or removed by us at any time
  • Understand that content you share publicly may be viewable by other users and may appear in search results
  • Grant us the licenses described in our Terms of Service with respect to content you submit
  • Respect content ratings and age-appropriateness guidelines for the specific app

We reserve the right to remove any user-generated content that violates this policy, without prior notice. We are not obligated to monitor all user-generated content, but we may do so at our discretion.

6. Reporting Violations

We rely on our user community to help maintain a safe and positive environment. If you encounter content or behavior that violates this Acceptable Use Policy, please report it using one of the following methods:

  • In-App Reporting: Use the "Report" or "Flag" button available on content and user profiles within our apps. This is the fastest way to report violations.
  • Email: Send a detailed report to ceo@kricketsllc.com with the subject "AUP Violation Report." Include the app name, a description of the violation, the username or content involved, and any screenshots or evidence.
  • Website: Submit a report through our contact form at kricketsllc.com/contact.

All reports are treated confidentially. We do not disclose the identity of the reporter to the person being reported, except where required by law. We do not tolerate retaliation against users who report violations in good faith.

7. Investigation and Enforcement

We take all reports of policy violations seriously and will investigate them promptly. Our enforcement actions are proportional to the severity of the violation and may include any combination of the following:

7.1 Content Removal

Content that violates this policy may be removed, hidden, or restricted without prior notice. We may also add warnings or labels to content that is borderline or contextually sensitive.

7.2 Account Warnings

For first-time or minor violations, we may issue a warning to the user explaining the policy violation and the expected behavior going forward. Warnings are recorded on the account and considered in future enforcement decisions.

7.3 Temporary Suspension

For repeated or moderate violations, we may temporarily suspend the user's account for a period ranging from 24 hours to 30 days, depending on the severity and frequency of the violations. During suspension, the user will not be able to access the app or its features.

7.4 Permanent Termination

For severe violations, repeated offenses despite prior warnings, or any activity that poses an immediate threat to user safety or the integrity of our Services, we may permanently terminate the user's account. Permanently terminated users are not permitted to create new accounts. Account termination may result in the permanent loss of all account data and content.

7.5 Law Enforcement Referral

For violations that involve illegal activity, we will report the matter to the appropriate law enforcement authorities. This includes, but is not limited to, child exploitation material, credible threats of violence, terrorism, fraud, and other criminal conduct. We will cooperate fully with law enforcement investigations and may provide user data as required by law or valid legal process.

8. Appeals Process

If you believe that an enforcement action taken against your account or content was made in error, you have the right to appeal. To submit an appeal:

  1. Email ceo@kricketsllc.com with the subject "AUP Appeal."
  2. Include your username, the app name, a description of the enforcement action, and your explanation of why you believe the action was incorrect.
  3. Provide any supporting evidence or context that may be relevant to your appeal.

We will review your appeal and respond within 14 business days. Appeals are reviewed by a person who was not involved in the original enforcement decision. The outcome of the appeal will be communicated to you via email, and the decision is final. We reserve the right to uphold, modify, or reverse the original enforcement action.

9. Cooperation with Law Enforcement

Krickets LLC cooperates with law enforcement agencies and regulatory authorities in accordance with applicable law. We may disclose user information, content, and account data in response to:

  • Valid court orders, subpoenas, warrants, and other legal process
  • Emergency requests involving imminent danger of death or serious physical injury
  • Requests from child safety organizations regarding child exploitation
  • National security requests as required by law

Where permitted by law, we will notify affected users of law enforcement requests. We may also proactively report illegal content or activity to law enforcement where we believe there is an imminent risk of harm.

10. Changes to This Policy

We may update this Acceptable Use Policy from time to time to reflect changes in our Services, user feedback, legal requirements, or industry best practices. When we make changes:

  • We will update the "Last updated" date at the top of this policy.
  • For material changes, we will provide notice through our apps (via in-app notification), by email, or by posting a prominent notice on our website.
  • Your continued use of our Services after the updated policy takes effect constitutes your acceptance of the changes.
  • If you disagree with any changes, you should stop using our Services and, if applicable, request account deletion.
